Local Media San Diego, its subsidiaries and affiliated companies (together, the “Company”), will conduct the Sweepstakes substantially as described in these rules, and by participating, each participant agrees as follows:
Description of Sweepstakes / Participation
A. Dates of Sweepstakes:
The Sweepstakes will begin on December 1, 2023 and end on December 17, 2023.
NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited. Odds of winning depend upon the number of participants.
B. How to enter:
Fill out the designated entry form at www.BigFMSD.com. Form must be completely filled out to qualify as an entry into the Sweepstakes.
At the conclusion of the sweepstakes period, one entry will be randomly selected and declared the winner, pending confirmation of eligibility.
Mail in and/or drop off as method of entry are accepted, please include the following information: participant full legal name, mailing address, contact phone number, e-mail address and date of birth. Address is 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121. Drop off available Monday through Friday, 10:00AM to 4:00PM. Mail in and drop off entries will not be returned to sender.
2. Prize(s)
One Prize Package that may be awarded to an eligible winner is four (4) tickets for 1-Day admission to Universal Studios Hollywood (the “Tickets”)(subject to restrictions). The approximate retail value (“ARV”) of each Ticket is one hundred twenty nine dollars ($129.00); a set of four (4) Tickets is five hundred sixteen dollars ($516.00).
Prize winner is strongly advised to seek professional legal, tax advice. Awarding of prizes could have material adverse consequences on the winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters.
Prizes are not transferable or exchangeable for any other prize, and must be accepted in whole. If a winner cannot be contacted within 48 hours, or is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.
Tickets will be delivered in the form of electronic tickets for distribution to each winner.
1-Day General Admission tickets will be subject to the following terms and conditions: 1-Day General Admission to Park (Valid on your selected date only). Additional restrictions may apply. Parking not included. Ticket is non-transferable, non-refundable and non-exchangeable. This ticket may not be altered, copied, transferred or resold. This ticket is only valid for the person named on it, or when accompanied by the person named on it. Ticket cannot be combined with other offers, separately ticketed events, discounts, Halloween Horror Nights or sightseeing tours. Please note the CDC advises that older adults and people of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. Guests should evaluate their risk in determining whether to attend. People who show no symptoms can spread COVID-19 if they are infected, any interaction with the general public poses an elevated risk of being exposed to COVID-19, and we cannot guarantee that you will not be exposed during your visit. By accepting admission, you assume all inherent risks and agree to release Universal and its affiliates from liability for illness (including communicable / infectious diseases), loss, injury, or damage related to your purchase or visit. Universal reserves the right to revoke the license granted by this ticket. Park, rides/shows/attractions, entertainment, experience details and/or access to event may be restricted or unavailable due to capacity/closures/other factors and benefits/restrictions are subject to change without notice. Theme park tickets must be used prior to January 30, 2024 or prize will be forfeited. Depending on crowd conditions, Virtual Line™ reservations may be required to enter SUPER NINTENDO WORLD™. If winner is unable to fulfill prize during time period, winner forfeits the prize package. Blackout dates or other restrictions may apply. All elements of the prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. If winner elects to partake in any or all portions of his/her prize with no guest, the prize will be awarded to winner only and any remainder of the prize will be forfeited and shall not be subject to further or alternative compensation. Winner must be eighteen (18) years of age or older. Prize Packages are non-transferable and have no cash value. Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, meals, unspecified ground transportation, phone calls, baggage, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the Prize and all such expenses are the sole responsibility of winner. All unclaimed and/or unused prize packages, will remain the property of Universal Studios Hollywood and may not be sold, exchanged or otherwise transferred by winner. All details of the Prize Packages will be determined by Universal Studios Hollywood in its sole discretion and Universal Studios Hollywood reserves the right to substitute a similar prize or prize element of comparable value. Tickets are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Universal Studios winners are responsible for all taxes and fees associated with prize receipt and/or use.
All tickets are valid during normal operating hours only. Operating hours and availability of attractions and shows are subject to change without notice. Some special events may be separately ticketed. Universal Studios Hollywood reserves the right to change the name of all tickets. Unless specifically indicated otherwise, all tickets specifically exclude admission to special or separately ticketed “hard ticket” entertainment events at any of the theme parks, hotels, or within any of the Universal CityWalk venues.
An inability to use any tickets will result in forfeiture of such tickets. No extensions will be granted.
Any damaged, lost or stolen theme park tickets will not be replaced.
Prices, times, dates, entertainment, event and/or experience details are subject to changes and/or cancellation without notice.
3. Eligibility and Limitations
Participants, contestants and winner(s) must be U.S. residents of San Diego County, at least 18-years old at the date of entry, have an active social security number, and be able to present the original social security card and California ID to officials before the prize is awarded.
Employees of the Company, Universal Studios Hollywood employees and affiliates, members of their immediate families, and/or persons living in the same households the Sweepstakes participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
4. Taxes
Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize unless otherwise noted. Any person winning over $600 in prizes from a station will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. Winner agrees to accept the prize “as is.”
5. Publicity; Use of Personal Information
By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Sweepstakes and waive any claims to royalty, right, or remuneration for such use. By participating in the Sweepstakes, participants agree that the Company may disclose personal information obtained from participants in the Sweepstakes to third parties and use such information for marketing and other purposes.
6. Affidavit
Winners may be required to sign and return an Affidavit of Eligibility and Release of Publicity and Liability within 14 days of notification of winning. Failure to sign and return the affidavit and release within such period or to comply with any term or condition of these Official Rules may result in disqualification and forfeiture of any interest in a prize.
7. Release
By participating, each participant and winner waives any and all claims of liability against the Company, its employees and agents, sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Sweepstakes, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by the Company.
The company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The company is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email, technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer or data related to or resulting from participating or downloading materials in this Web site or Sweepstakes. The company is not responsible for cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the Sweepstakes, or to defraud the Sponsor in any way, may be prosecuted to the fullest extent of the law. Participants engaging in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the Sweepstakes is not capable of operating as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the company which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the company reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes and award prizes among eligible entries received.
8. Decisions
By participating in the Sweepstakes, participants agree to be bound by the decisions of Company personnel. The Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Company believes has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion.
9. Miscellaneous
Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize. No purchase necessary to participate or win. Purchase does not increase chance of winning. Void where prohibited. Odds of winning depend upon the number of participants. The Company may substitute prizes, amend the rules or discontinue the Sweepstakes at any time as announced on the Station(s). The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes. Written copies of these rules are available during normal business hours at the business offices of the Station(s) and by mail upon written request with a stamped, self-addressed return envelope.
Universal City Studios LLC d/b/a Universal Studios Hollywood is a prize provider only in this promotion; is not a sponsor of this promotion; and is not responsible for the administration of the promotion, the collection of the entries or the selection of any winner. Any disputes, claims, and causes of action against Universal Studios Hollywood arising out of or relating to any person’s use of, or participation in any portion of the prize involving Universal Studios Hollywood shall be resolved by applying the laws of California, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in state or federal courts within Los Angeles, California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
In connection with any visit to Universal Studios Hollywood, please be advised that Sponsor’s and Universal’s policies, CDC guidelines, and the recommendations of health officials must be followed. In addition, guests should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before visiting any Universal destination. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsor and Universal cannot guarantee that any person will not be exposed during a visit.
By accepting the Prize, winner, on behalf of him or herself and on behalf of any individuals who use the Prize, expressly assumes the risk that during use of the Prize they may be exposed to COVID-19, the Coronavirus that causes COVID-19, or other communicable and/or infectious diseases. Winner and Guests, if any, expressly understand that these risks include contracting COVID-19 or other communicable and/or infectious diseases and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other communicable and/or infectious diseases.
All parts of the Prize selected are subject to availability and blackout dates, and subject to change without written notice or warning. Should an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities, epidemics, pandemics and the spread of infectious diseases, including without limitation COVID-19 (as defined by the World Health Organization and any of the strains, variants or mutations thereof), and any related governmental or judicial actions taken in connection with, or as a response to, any such event, or any other event beyond the reasonable control of a party, whether or not existing, known, foreseen or foreseeable at the time this Sweepstakes occurs, render the redemption or fulfilment of some or all of the Prize delayed, hindered, adversely affected, impracticable, or impossible, Universal Studios Hollywood in its sole and absolute discretion, reserves the right to evaluate and make modifications to the redemption and fulfilment processes and timelines for the Prize or portion of the Prize for which Universal Studios Hollywood is responsible for, which may include but is not limited to providing additional time for redemption and/ or fulfilment. Should the Prize become unavailable, experiences and items of a similar nature and value may be offered.
10. Winner’s List
For a Winner’s List, available thirty (30) days following the end of the Sweepstakes Period, send a self-addressed, stamped envelope to: Local Media San Diego, Attn: Big-FM Universal Studios Hollywood Sweepstakes winner, 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121. Please include the following in your Winner’s List request: Your full legal name, name of station and indicate which winner’s list you would like to receive. Please include one self-addressed, outer postmarked envelope for every list requested.
11. Compliance with Law
The conduct of the Sweepstakes is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein. Station(s) shall follow the applicable laws for conducting Sweepstakes, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Sweepstakes, etc. as required by local and state law.
