Official Contest Rules

100.7 BIG-FM (KFBG-FM) & LOCAL MEDIA SAN DIEGO ARE NOT RESPONSIBLE FOR ANY EVENT / PRIZE CHANGES AND / OR CANCELLATIONS. 

General rules may be picked up at 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121, Monday – Friday during normal business hours.

Local Media San Diego, its subsidiaries and affiliated companies (together, the “Company”), will conduct the Contest substantially as described in these rules, and by participating, each participant agrees as follows:

1. Description of Contest / Participation
A. Dates of Contest:
The Contest will begin on April 10, 2023 and end on April 28, 2023.

NO PURCHASE NECESSARY.  PURCHASE DOES NOT INCREASE ODDS OF WINNING. Void where prohibited.  Odds of winning depend upon the number of participants.

B. How to enter:
Fill out the designated entry form at www.BigFMSD.com. Form must be completely filled out to qualify as an entry into the Contest.

A name will be randomly selected among all entries and announced weekdays on BIG-FM 100.7 FM San Diego at or around 9:00AM, 10:00AM, 11:00AM, 12:00PM, 1:00PM, 2:00PM, 3:00PM, 4:00PM, and 5:00PM. 

If your name is announced, call the Big-FM Studio at 888-570-1007 within 10 minutes of the name being announced. Listeners who successfully call in will instantly win a 100.7 Big-FM t-shirt and become a qualifier for that day’s qualifying prize. One name will be randomly selected among that day’s qualifiers to win the daily qualifying prize of a $100 Disney Gift Card, and also be a finalist for the Grand Prize. One finalist at the end of the campaign will be randomly selected to win the Grand Prize.

Mail in and/or drop off as method of entry are accepted, please include the following information: participant full legal name, mailing address, contact phone number, e-mail address and date of birth.  Address is 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121.  Drop off available Monday through Friday, 10:00AM to 4:00PM.  Mail in and drop off entries will not be returned to sender.

Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations. Contest Participants should not rely on streamed broadcasts.

2. Prize(s)
All qualifiers will receive a 100.7 Big-FM T-Shirt (Prize value: $20)

One daily qualifying prize that may be awarded to an eligible winner is a $100 Disney Gift Card (Prize value: $100).

One grand prize that may be awarded to an eligible winner is one Disney Cruise Vacation Package: a four (4) night Disney Cruise Line vacation for four (4) persons (i.e., Prize Winner and up to three (3) guests), to be taken aboard the Disney Magic or Disney Wonder, and a one (1)-night stay in San Diego prior to the cruise, consisting of the following components:

The Disney Cruise shall consist of the following:

  • Round trip ground transportation for up to four (4) persons from Winner’s residence to the Port of San Diego, and from Port of San Diego to the Winner’s residence or voucher(s) for local round-trip ground transportation service or parking for one (1) vehicle near Port of San Diego (at the discretion of Disney Cruise Line and if winner resides inside a 200-mile radius of San Diego, CA);
  • One (1) four (4) night Cruise on the Disney Magic or Disney Wonder for up to four (4) persons, consisting of:
  • One (1) stateroom aboard the Disney Magic or Disney Wonder (location/category at the discretion of Disney Cruise Line) with a maximum occupancy four (4) people;
  • All meals onboard the Disney Magic or Disney Wonder (excluding specialty dining)
  • Pre-paid onboard gratuities for the stateroom host/hostess, dining room server, assistant server and head server
  • Taxes, Fees, and Port Expenses (as defined on the Disney Cruise Line website)

All costs and expenses not expressly stated in the Vacation Package description above are excluded and solely the responsibility of Prize Winner and his/her/their guests, including but not limited to:

  • Shore Excursions
  • Travel insurance
  • Laundry service
  • Spa treatments
  • Alcoholic and specialty non-alcoholic beverages (including specialty coffee)
  • Individually charged snacks and treats (including but not limited to movie popcorn, packaged candy, ice cream, gelato, pastries, and bar snacks)
  • Local and long distance telephone calls
  • Ship to shore communications including internet
  • Merchandise and souvenirs
  • Tips and gratuities not specifically set forth above

Approximate retail value (“ARV”) of the four (4)-night Grand Prize: $6,812.92, which includes Taxes, Fees, and Port Expenses (as defined on the Disney Cruise Line website).

The actual value of the Vacation Package may vary depending on point of departure and fluctuations of rates and airfares. If the actual value of the Vacation Package is less than stated ARV, the difference will not be awarded. Vacation Package components may not be sold, traded, transferred, or refunded. Vacation Package is not redeemable for cash. Vacation Package is non-commissionable.

Travel for the Vacation Package must be booked at least forty-five (45) days prior to the intended travel dates and must occur from October 1, 2023 to May 31, 2024. Disney Cruise Line reserves the right to change the allowable travel dates, cruise ship or any other component of the Vacation Package, for any reason and in its sole discretion. No substitution of Vacation Package or any elements thereof is allowed, except at Disney Cruise Line’s sole discretion. Ports of call, offerings and experiences onboard are subject to change, availability and cancellation without notice.

Block Out Dates at the sole discretion of Disney Cruise Line and subject to change.

The Prize Winner and up to three (3) guests must travel together on the same itinerary. Once selected by the Prize Winner, guests cannot be changed without the express consent of Disney Cruise Line, which may be withheld for any reason. If the Prize Winner chooses to bring less than the allotted number of guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute Vacation Package or compensation provided to the Prize Winner.

Vacation Package fulfillment is subject to restrictions and availability. The Vacation Package must be booked through a travel agent as designated by Disney Cruise Line at least forty-five (45) days prior to the intended departure date. No refund of compensation will be made in the event of the cancellation or delay of any flight or cruise. Disney and Disney Cruise Line are not liable, including for any costs or expenses, if any component of the Vacation Package is delayed, postponed or cancelled for any reason and Prize Winner will not be reimbursed, and no substitution will be provided except as in Disney Cruise Line’s sole discretion.

The Prize Winner and his/her/their guests are responsible for providing proper citizenship documentation to travel which may include passports, valid alien registration card and/or necessary visas. Those without proper citizenship documentation will be denied boarding. The Prize Winner and each guest is responsible for ensuring that they have proper citizenship documentation.

The Prize Winner and his/her/their guests will be required to execute a liability/publicity/COVID-19 release and waiver form prior to booking of any travel. The Prize Winner and each guest will also be required to sign the Disney Cruise Line cruise contract before embarkation (the “Cruise Contract”). The Cruise Contract is available at www.disneycruise.com/cruisecontract. Failure to return the executed release form or to accept and sign the Cruise Contract within the specified time periods will result in forfeiture of the Vacation Package. Prize Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of their travel party, related to any use or misuse of the Vacation Package or any related activity or travel.

The Prize Winner and his/her/their guests are required to comply with Disney Cruise Line’s health and safety measures and operational guidelines, including but not limited to, vaccination, face covering, COVID-19 testing and physical distancing requirements. Persons not meeting embarkation requirements will be denied boarding. Visit www.disneycruise.com/updates for the latest information.

Health and safety measures and operational guidelines, ports of call and offerings may change at any time without notice. Certain onboard venues, experiences and other offerings may be modified or unavailable, will have limited capacity and will be subject to limited availability, advance reservations or even closure.

Minors under the age of eighteen (18) not traveling with a parent or legal guardian must be accompanied by an adult over the age of twenty-one (21) in the same stateroom. The parent or guardian of any minor not travelling with a parent or guardian must appoint an adult to have custody and control over their minor and to contract on their behalf in connection with the Disney Cruise Line vacation. An appointment form will be included in the document package and must be signed by parent or legal guardian prior to embarkation at the Disney Cruise Line terminal. Sponsor shall have the right, but not the obligation, to make any deductions and withholdings that Sponsor deems necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances.

Sponsor shall have no responsibility  or liability for cancellations, delays, or any other change by any company or person providing any element of Vacation Package due to reasons beyond Sponsor’s control, and are not responsible or liable for any expenses incurred as a consequence thereof. The guests, if any, may be required to execute and return releases of liability and, where legal, publicity releases (collectively, “Guest Documents”), which must be returned with the verification documents requested of Prize Winner, or guest portion of the Vacation package will be forfeited.

Federal, state and local taxes, if any, are the sole responsibility of the Grand 

Prize Winner, who will receive an IRS Form 1099 reflecting the final actual value of any prize valued at $600 or more.

Prize winner is strongly advised to seek professional legal, tax advice. Awarding of prizes could have material adverse consequences on the winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters.

Prizes are not transferable or exchangeable for any other prize, and must be accepted in whole.  If a winner cannot be contacted within 48 hours, or is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.  

3. Eligibility and Limitations
Participants, contestants and winner(s) must be U.S. residents of San Diego County, at least eighteen (18) years old at the date of entry, have an active social security number, and be able to present the original social security card and California ID to officials before the prize is awarded. Travelers under the age of eighteen (18) must be accompanied by a parent/legal guardian who must be at least twenty-one (21) years of age.

Employees of the Company, the Contest participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win.  The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

4. Taxes
Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.  Each winner is solely responsible for reporting and paying any and all applicable taxes. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.  Prizes are not transferable, redeemable for cash or exchangeable for any other prize unless otherwise noted.  Any person winning over $600 in prizes from a station will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.  Winner agrees to accept the prize “as is.”

5.  Publicity; Use of Personal Information
By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Contest and waive any claims to royalty, right, or remuneration for such use.  By participating in the Contest, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.

6. Affidavit
Winners may be required to sign and return an Affidavit of Eligibility and Release of Publicity and Liability within 14 days of notification of winning. Failure to sign and return the affidavit and release within such period or to comply with any term or condition of these Official Rules may result in disqualification and forfeiture of any interest in a prize.

7.  Release
By participating, each participant and winner waives any and all claims of liability against the Company, its employees and agents, sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize.  In order to receive a prize, participants must sign an official waiver form provided by the Company.

The company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The company is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email, technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person’s computer or data related to or resulting from participating or downloading materials in this Web site or Contest. The company is not responsible for cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the Contest, or to defraud the Sponsor in any way, may be prosecuted to the fullest extent of the law. Participants engaging in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the Contest is not capable of operating as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the company which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the company reserves the right at their sole discretion to cancel, terminate, modify or suspend the Contest and award prizes among eligible entries received.

8. Decisions
By participating in the Contest, participants agree to be bound by the decisions of Company personnel.  The Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who the Company believes has violated any rule, gained unfair advantage in participating in the Contest, or obtained winner status using fraudulent means.  The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final.  If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate this Contest, or make such other decisions regarding the outcome as the Company deems appropriate.  All decisions will be made by the Company and are final.  The Company may waive any of these rules in its sole discretion.

9. Miscellaneous
Each winner must submit proof of eligibility and sign the Company’s release form to claim the prize.  No purchase necessary to participate or win.  Purchase does not increase chance of winning.  Void where prohibited.  Odds of winning depend upon the number of participants.  The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station(s).  The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.  Written copies of these rules are available during normal business hours at the business offices of the Station(s) and by mail upon written request with a stamped, self-addressed return envelope.

Certain travel restrictions apply.

Promoter is the sponsor of the Sweepstakes.

Disney, its parent, related and affiliated and subsidiary entities and their respective officers, directors, agents, employees and assigns will be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or are in any way related to the prize, the receipt, use and/or enjoyment of the prize, any prize-related activity and/or the Promotion.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail and govern.

10. Winner’s List
For a Winner’s List, available thirty (30) days following the end of the Contest Period, send a self-addressed, stamped envelope to: Local Media San Diego, Attn: Big-FM Disney Cruise winner(s), 6160 Cornerstone Court East, Suite 150, San Diego, CA 92121. Please include the following in your Winner’s List request: Your full legal name, name of station and indicate which winner’s list you would like to receive. Please include one self-addressed, outer postmarked envelope for every list requested.

11. Compliance with Law
The conduct of the Contest is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein.  Station(s) shall follow the applicable laws for conducting Contest, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.
